If the ruling had immediately been 15 months, the throwing would have been much less justified and whatever punishment he gets would be therefore harsher.

If that affects it at all, it decreases the punishment the father will get. If the ruling had immediately been 15 months, the throwing would have been much less justified and whatever punishment he gets would be therefore harsher.
